Lumacast 3D Model End User License Agreement

This End User License Agreement (“Agreement”) governs your use of any DWG, SketchUp, or other 3D model files, including associated documentation, textures, or assets (collectively, the “3D Files”) provided by Lumacast, Inc. (“Licensor”).

By downloading, purchasing, or otherwise accessing the 3D Files, you (“Licensee”) agree to be bound by this Agreement. If you do not agree, do not download, purchase, or use the 3D Files.

1. License Grant

Licensor grants Licensee a non-exclusive, non-transferable, non-sublicensable, revocable license to use the 3D Files solely for:

  • project visualization, design development, and documentation;
  • creation of architectural drawings, renderings, or construction documents;
  • internal business use and client presentations.

This license is granted only through a valid purchase from Lumacast’s online store or, if applicable, through the Lumacast Trade Program at no cost. In both cases, use of the 3D Files is governed by this Agreement.

2. Restrictions

Licensee may not:

  1. Sell, rent, lease, sublicense, share, or redistribute the 3D Files, whether modified or unmodified.
  2. Publish, upload, or make the 3D Files (in whole or part) available in any public repository, library, or file-sharing platform.
  3. Modify the 3D Files to create derivative products for resale, including altered versions marketed as Licensee’s own models.
  4. Use the 3D Files in software, websites, or applications that allow end users to extract or access the original files.
  5. Use the 3D Files or any derivatives for training artificial intelligence or machine learning systems.
  6. Circumvent the purchase or download process (e.g., unauthorized access outside of Lumacast’s storefront).

3. Permitted Use

  • Licensee may incorporate the 3D Files into project deliverables, including drawings, renderings, and presentations prepared for clients.
  • Licensee may share project files containing the 3D Files with consultants, contractors, or subcontractors if strictly necessary for the project, provided such parties do not retain, reuse, or redistribute the 3D Files outside the scope of that project.
  • Licensee may make one backup copy of the 3D Files for archival purposes.

4. Intellectual Property

All rights, title, and interest in the 3D Files remain exclusively with Lumacast, Inc. Licensee is granted only the limited rights expressly stated in this Agreement. Nothing in this Agreement transfers ownership of the underlying designs represented by the 3D Files.

5. Fees and Trade Program Access

Non-trade customers may purchase access to the 3D Files for the listed price on Lumacast’s online store. Approved Lumacast Trade Program members may access the 3D Files at no cost by logging in with their registered account. Whether purchased or redeemed through the Trade Program, all access is subject to this Agreement.

6. Warranties and Disclaimer

The 3D Files are provided “as-is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or compatibility with specific workflows or software. Lumacast does not guarantee that the 3D Files are error-free, or that they will meet Licensee’s expectations in all design environments.

7. Limitation of Liability

In no event will Lumacast be liable for incidental, indirect, or consequential damages, including lost profits, lost opportunities, or business interruption, arising out of the use of or inability to use the 3D Files. Lumacast’s maximum liability under this Agreement shall not exceed the purchase price paid for the 3D Files, if any.

8. Termination

This Agreement and Licensee’s rights under it will terminate automatically if Licensee fails to comply with any term of this Agreement. Upon termination, Licensee must immediately cease use of and destroy all copies of the 3D Files.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in California.
